El principio de oportunidad del sistema penal colombiano es un mecanismo procesal que consiste en la posibilidad y facultad legal que tiene la Fiscalía General de la Nación de interrumpir, suspender o desistir de la acción penal en los taxativamente indicados por la legislación vigente. Este se encuentra regulado por el artículo 250, en sus relaciones con la Constitución Política y el Código de Procedimiento Penal – Ley 906 de 2004. Se utiliza para descongestionar el sistema penal, que funciona como herramienta para los fiscales para tomar decisiones. Estos asuntos deben ser de poca cuantía, esto quiere decir que no son delitos graves, por lo tanto, el aparato judicial debe centrarse en hechos más contemporáneos. No obstante, al utilizarlo para los delitos de violencia intrafamiliar, hay dificultades legales en términos de protección de la víctima y el derecho a la impunidad. La violencia intrafamiliar puede ver debilitada la justicia por hechos. Al no haber sanción a los infractores, esto puede dar una impresión de que lo denunciado no tiene tanta categoría lo que genera una mala percepción del público. Hay revictimización ya que, con los acuerdos, se tiende a negociar condiciones que no cumplen con las expectativas de las involucradas por la situación desventajosa |

The principle of opportunity in the Colombian criminal system is a procedural tool that allows and empowers the Attorney General's Office to interrupt, suspend or waive punitive actions in certain cases, regulated by Article 250 of the Constitution and the Criminal Procedure Code (Law 906 of 2004). Its purpose is to speed up justice by reducing the workload of the judicial system and focusing on less relevant crimes. However, its use in crimes such as domestic violence poses significant challenges in terms of protecting victims' rights and the possibility of impunity. In the case of domestic violence, this principle can weaken the justice process. The lack of adequate sanctions for offenders could lead to the perception that these crimes are not treated with the necessary seriousness, which could affect public confidence in the justice system. In addition, victims run the risk of being re-victimized, since the principle of opportunity can lead to negotiating agreements that do not adequately reflect their interests, particularly in situations of vulnerability. |
